TERMS AND CONDITIONS
This document (together with any documents referred to in it) tells you the terms and conditions upon which we sell and supply the goods (the 'Goods') to you.
Before confirming your order please:

By ordering any of the Goods listed on this Website or any product from The White Rose Cake Company, you agree to be legally bound by these Terms and Conditions. You will be unable to proceed with your purchase if you do not accept these terms and conditions as may be modified or amended and posted on this Website from time to time.
We reserve the right to revise and amend the Website, our disclaimers and the Conditions at any time without notice to you. Your continued use of the Website (or any part thereof) following a change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether we have changed these Conditions.
1. ABOUT US
This Website is owned and operated by The White Rose Cake Company.
2. PAYMENT, CANCELLATION RIGHTS AND REFUNDS.
Online orders: Payment can be made by any major credit or debit card through Pay Pal, www.paypal.com.
By placing an order, you consent to payment being charged to your debit/credit card account as provided on the order form.
Wedding cake orders: We require a 50% deposit to secure your date. All deposits are non-refundable and non-transferable. Please pay balances to account 10258080 167001 with your name as the reference.
Cleared payment of the entire balance must be received by the due date shown on your order form (normally 6 weeks prior to the date you require your cake) for work on your cake to be completed.
In the event of non-payment of the balance by the due date shown on your order form, we reserve the right to consider the order cancelled and the deposit forfeited.
Cake orders which are cancelled at short notice (within 6 weeks of the event) will still be charged for in full as we are rarely able to rebook dates at such short notice. Any work carried out is also chargeable.
For orders with less than six weeks’ notice, full payment is required at time of order confirmation and is non-refundable.
Celebration and Novelty cakes: We require a 50% deposit to secure your date. All deposits are non-refundable and non-transferable. The remaining balance must be paid and cleared at least 4 weeks prior to the date you require your cake. In the event of non-payment of the balance by the due date shown on your order form, we reserve the right to consider the order cancelled and the deposit forfeited.
Full payment is required at time of order confirmation if the date you require the cake is less than 4 weeks away, and is non-refundable.
In all cases your order and date will only be secured once payment has been received and cleared in full.
With any cake, alterations to your original cake design may be possible and every effort will be made to do so, all changes to your design should be made in writing and may involve an extra charge.
As all of our products are custom made, personalised, and perishable goods we do not offer refunds.
No Refunds will be given after the cake has been collected or delivered. You will be required to sign a delivery and satisfaction form.
To cancel your subscription please email alex@thewhiterosecakecompany. Subscriptions are re-billed on the 1st of each month, if your cancellation is after this date the cancellation will be effective from the following month.
Online orders: All cakes ordered via our website are either collection only from Hurstpierpoint or delivered to Brighton and Hove only. We reserve the right to cancel any orders made where the delivery area is outside of Brighton and Hove unless agreed prior to order being placed and a confirmation email stating this has been received from The White Rose Cake Company.
All other Cake orders: Collection or delivery requirements of your cake will be discussed before your order is placed and noted on you order form. If a delivery charge is being applied this will also be discussed and noted on your order form prior to your order being placed.
If we are providing a delivery and set up service we will liaise with your venue prior to delivery to schedule a delivery slot and check that all arrangements for assembly such as cake stand and table have been taken care of.
At point of delivery the cake becomes the responsibility of the venue, this is confirmed in the form of a signature by a nominated person i.e. your wedding planner or other member of staff at your venue.
4. ALLERGY INFORMATION.
Our cakes contain butter, gluten (wheat) and eggs and are made in an environment that handles nuts, soya and alcohol. We are happy to make nut, gluten and alcohol free cakes however due to the nature of production we cannot guarantee a nut, gluten or alcohol free environment when making our cakes. The White Rose Cake Company accepts no liability to customers suffering from an allergic reaction from eating our products.
5. FORCE MAJEURE CLAUSE (English law)
We shall not be deemed in default of this Agreement, nor shall it hold the other Party responsible for, any cessation, interruption or delay in the performance of its obligations (excluding payment obligations) due to earthquake, flood, fire, storm, snow, natural disaster, act of God, war, terrorism, armed conflict, labour strike, lockout, boycott or other similar events beyond the reasonable control of the Party, provided that the Party relying upon this provision:
· gives prompt written notice thereof, and
· takes all steps reasonably necessary to mitigate the effects of the force majeure event. If a force majeure event extends for a period in excess of 30 days in the aggregate, either Party may immediately terminate this Agreement upon written notice.
We will only ever use your contact details for the purpose for which you have contacted us.
We never pass on your details to any third party.
